These Terms and Conditions set out the basis on which tree surgeons in Kingston provide arboricultural services to residential and commercial clients across the UK. By making a booking, requesting a quotation, or instructing work to begin, the customer agrees to these terms. They are intended to create a clear understanding of the service arrangement, payment obligations, safety requirements, and the limits of liability that apply to tree surgery services. Where a written quotation, schedule, or service note differs from these terms, the written document will take priority to the extent of any inconsistency.
These terms apply to all work carried out by the provider, including but not limited to tree pruning, tree removal, stump grinding, crown reduction, crown thinning, hedge maintenance, emergency call-outs, and associated site clearance. References to tree surgeons Kingston, the company, we, or us mean the service provider. References to the customer, you, or your mean the person or organisation requesting the works, whether they are the property owner, occupier, tenant, landlord, managing agent, or another authorised representative.
All services are provided in accordance with applicable UK law, health and safety obligations, environmental duties, and any planning or property restrictions that may apply. Customers are responsible for ensuring that they have the legal right to request the work and that any necessary permissions, consents, or notices are in place before the work date unless we have expressly agreed in writing to manage that process on the customer’s behalf.
Booking begins when you submit an enquiry and we provide a quotation, estimate, or proposed scope of work. A booking is only confirmed once you accept our quotation and we confirm a date or time window in writing, by email, text message, or other recorded method. Any dates provided before confirmation are indicative only and may change because of weather, access issues, equipment availability, plant conditions, or operational delays. We will make reasonable efforts to attend at the agreed time, but time is not of the essence unless we expressly state otherwise.

Payment terms will be set out in the quotation or invoice. If payment is not made by the due date, we reserve the right to suspend further work, withhold reports or documentation, and charge reasonable recovery costs where permitted by law. If you cancel a confirmed booking, we may charge a cancellation fee to cover administration, allocated staff time, machinery preparation, and lost opportunity costs, particularly where the booking was scheduled at short notice or where specialist equipment was reserved. The amount of any charge will be reasonable and proportionate, taking into account the timing of the cancellation and the work already committed.
If cancellation occurs after materials have been ordered, permits have been arranged, or subcontractors have been engaged, you may be liable for those non-recoverable costs. If you wish to move the appointment, we will try to offer an alternative date, subject to availability. Weather-related postponements may be necessary for safety reasons. In such cases, we will reschedule the work at the earliest suitable opportunity, and no cancellation fee will normally apply where the delay is due to unsafe working conditions or force majeure events.
We may cancel or postpone a booking where conditions make it unsafe or unlawful to proceed, including severe weather, unsafe access, equipment failure, unexpected nesting or protected wildlife issues, emergency incidents, or if the customer fails to provide required permissions or access. If we cancel for reasons within our control, we will offer a new date or refund any amount paid for work not yet performed, subject to deductions only where permitted by law and where costs have already been reasonably incurred.
Liability is limited to the extent permitted by law. We will carry out tree surgery and related services with reasonable care and skill, using competent staff and appropriate equipment. However, trees are living structures and can behave unpredictably. Where work involves deadwood, decay, decay pockets, brittle limbs, root instability, or storm-damaged trees, there is an inherent risk of movement, breakage, or hidden defects that may not be apparent during inspection. You accept that such risks are part of arboricultural work and that absolute guarantees cannot be given.
We are not responsible for pre-existing defects, hidden structural issues, historic damage, or conditions that were not reasonably discoverable before work commenced. We also will not be liable for loss or damage caused by inaccurate information supplied by the customer, failure to disclose relevant hazards, unauthorised interference with the site, or the action or inaction of third parties. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded under UK law.
Where our work causes accidental damage despite reasonable care, our liability will normally be limited to the direct cost of repair or replacement of the affected item, subject to the maximum extent allowed by law and any applicable insurance cover. We do not accept liability for indirect or consequential losses, including loss of profit, business interruption, loss of enjoyment, or consequential property damage, except where such exclusion is prohibited by law. You are responsible for removing or protecting fragile items, vehicles, ornaments, garden furniture, cables, and other property within the work zone unless we have agreed otherwise in writing.
Waste arising from tree surgery, including timber, branches, leaves, woodchip, stump grindings, and general green waste, will be handled in accordance with applicable waste management rules and environmental requirements. We will decide, unless otherwise agreed, how waste is stacked, removed, processed, or recycled. Waste remains subject to our operational control until the job is complete and may be reused, chipped, mulched, transported, or disposed of through licensed or authorised routes in line with relevant legislation.
If you ask us to leave timber, logs, brash, or woodchip on site, you accept responsibility for its storage and future use once it has been left in your chosen location. We may refuse to leave waste if doing so would create a safety hazard, block access, conflict with site restrictions, or breach waste-handling rules. Where waste is removed, we aim to minimise environmental impact by prioritising reuse and lawful recycling where possible. Any stated waste charge covers collection, handling, transport, and disposal or processing as applicable.
We will comply with duties relating to controlled waste, fly-tipping prevention, and proper transfer arrangements. If any waste requires special handling due to contamination, disease, pests, invasive species, or statutory restrictions, the customer must disclose this before the work date. Additional charges may apply where specialist disposal or containment is required. Customers must not ask us to remove material that is not part of the agreed tree surgery scope unless it has been priced and accepted in advance.
Customers must ensure that the site is ready for the agreed work date, including providing access to gates, driveways, communal areas, and, where applicable, parking or loading space. If we cannot gain access, or if the site is not ready because of locked gates, obstructed entrances, unannounced pets, unsafe ground, or missing permissions, we may charge for wasted attendance or rearrangement costs. Any utilities, overhead services, underground services, irrigation systems, or hidden structures must be identified by the customer where known.
We may suspend work immediately if we identify a serious safety concern, unlawful instruction, or an unforeseen condition that makes continued activity unsafe or inappropriate. In such circumstances, we will act reasonably and communicate the issue promptly. Our team may use ropes, climbing systems, mechanical equipment, chainsaws, stump grinders, and vehicles appropriate to the job. The customer agrees not to interfere with equipment, work methods, or exclusion zones during the operation.
All intellectual property in quotations, reports, drawings, assessments, and written material remains our property unless expressly transferred. Any written advice provided is based on the information available at the time and should not be treated as a warranty that future tree behaviour will match the condition observed on the inspection date. Nothing in these terms affects your statutory rights as a consumer where applicable. If you are a business customer, you confirm that you have authority to enter into the contract and that the services are being acquired for business purposes where stated. Force majeure events, including storms, floods, fire, epidemic restrictions, industrial action, transport disruption, or other events beyond reasonable control, may delay or prevent performance without the company being liable for resulting losses, provided we act reasonably and notify you as soon as practicable.
Any complaints should be raised promptly so that we can review the issue and, where appropriate, inspect the work. We will consider reasonable remedial steps where a valid issue is identified and where such steps are proportionate. These terms, together with the quotation and any written variations, form the entire agreement between the parties and supersede earlier discussions or representations, except where those representations were made fraudulently or are incorporated by law.
These terms are governed by the laws of England and Wales. Any dispute arising from or in connection with the services, including the booking process, payment obligations, cancellation charges, liability issues, or waste handling arrangements, shall be subject to the exclusive jurisdiction of the courts of England and Wales.
